Right to Buy

Spire View HousesThe Right to Buy for Spire View Tenants varies depending on when you became a tenant. If you became a tenant of Garngad Housing Association as part of the stock transfer from Glasgow City Council, you have a ‘Preserved Right to Buy’ for as long as you live in your current home. This means your discount remains the same as it was with the Council and Garngad. However, if you transfer home voluntarily, you will have the ‘Modernised Right to Buy’ as detailed below. Those tenants who moved because their house was demolished, keep the ‘Preserved Right to Buy’.

All other Spire View tenants have the ‘Modernised Right to Buy’. This means that, from 30 September 2002 you are accruing discount entitlement if you have built up five years continuous tenancy with one or more housing associations or local authorities. However, you will not be able to exercise your right to buy before 30th September 2012, but this cannot be guaranteed.

In addition, the Housing (Scotland) Act 2010 has now received Royal Assent and its provisions will be introduced at various stages over the next year.  One of the major provisions of the Act is the proposal to abolish the Right to Buy for all new houses in the socially rented sector.  This means that any new properties built since June 2008 will be exempt from Right to Buy.  This also includes properties acquired by Spire View on or after 25 June 2008, for instance where we have purchased a sharing owners part of their house.  This means that these properties will be available in the socially rented sector to increase the number of affordable rented homes available.  This will not have a huge impact on Spire View as the majority of our properties were built or acquired before 2008.

The Act also removes the Right to Buy from any tenants new to social housing after March 2011.
